《古巴共和國憲法》（西班牙語：Constitución de la República de Cuba）是古巴共和國的憲法，是古巴具有最高法律效力的法律文件，其規定了古巴共和國是「主權獨立的社會主義國家，是一個民主、統一的共和國，由全體勞動者組成，謀求政治自由、社會公正、個人和集體利益及人民團結」。古巴憲法是古巴一切制度的基礎，古巴憲法創製了全國政權機關（同時也是古巴的立法機關）全國人民政權代表大會，創製了古巴的行政機關古巴國務委員會（2019年修憲之前是古巴共和國最高行政機關），並創製了古巴的審判機關最高人民法院。[1][2]

古巴憲法還賦予公民以武力方式保衛憲法的權利，其第一章第一部分第一條規定：「公民有權採取一切手段，包括在其他手段無法行之有效的情況下，採取武裝鬥爭的方式，反對任何企圖推翻憲法所規定的政治、社會和經濟秩序的人。」[3]

自贏得獨立以來，古巴有過幾部憲法。古巴革命以來的第一部憲法於1976年起草，此後進行了修訂。2018年，古巴開始對其憲法進行重大修訂。[4] 現行憲法於2019年頒布。[5][6][7]

2019年憲法

2018年7月14日，古巴共產黨工作組起草了新憲法文本，然後將其提交給由黨第一書記勞爾·卡斯特羅領導的全國人民政權代表大會常務委員會，以評估、完善並將新憲法草案提交全國人民政權代表大會全體會議。這些改革被視為古巴政府現代化改革嘗試的一部分。[8]憲法草案包含87條新條款，總數從137條增加到229條。改革內容如下：[8][9][10][11][12][13][14]

  • 社會主義公有制下私有財產的承認。
  • 設立古巴共和國主席和恢復總理的職位，將其作為取代國務委員會主席職權和部長會議主席職權的新職位。
  • 古巴國務委員會主席變更職權由全國人民政權代表大會主席兼任。
  • 增設新的市人民議會議長職位中增設人民市長職位。地方市人民政權代表大會主席的職銜改為市長。
  • 規定國家主席任命的省長和副省長鬚得到當地黨委和市政府的批准。
  • 對氣候變化及其威脅的認識。
  • 成立由市領導組成的省級人民委員會。
  • 對主席設立兩個連續五年任期的限制。
  • 將婚姻定義為「一種社會和法律制度」和「一種家庭組織形式」（以前包括同性婚姻合法化）。
  • 將市議會代表的任期延長至五年。
  • 禁止基於性別、種族、民族血統、性取向、性別認同或殘疾的歧視。
  • 恢復司法系統中的無罪推定製度，該制度最後一次規定是在1940年憲法中。

2018年12月12日至13日，古巴共產黨中央委員會第八次全體會議討論了新憲法。會議上，全國人民政權代表大會委託的一個小組起草了擬議憲法的修正案。[15][16] 2019年2月24日，新憲法獲得90.15%的選民批准，投票率為 84%。[17][18][19][20][21][22]新憲法於2019年4月10日如期公布，新憲法公布後並予以通過。[23] [24][25]
