維基媒體基金會等訴國家安全局等案（英語：Wikimedia Foundation, et al. v. National Security Agency, et al.），是指包括擁有維基百科網站的維基媒體基金會聯合美國刑事辯護律師協會（英語：National Association of Criminal Defense Lawyers）、人權觀察、國際特赦組織美國分會（英語：Amnesty International USA）、國際筆會美東分會（英語：PEN American Center）、全球婦女基金會（英語：Global Fund for Women）、《國家週刊》、拉瑟福德學會（英語：Rutherford Institute）及拉美地區駐華盛頓辦公室（英語：Washington Office on Latin America）八大組織[2][3][4]，委託美國公民自由聯盟為訴訟代理人，向美國國家安全局與美國司法部發起的訴訟，指控兩者對維基百科的用戶實施群眾監控。[5][6][7] 訴訟人聲稱，國家安全局與司法部的上游收集（英語：Upstream collection）監聽計畫違反了《美國憲法第一修正案》中的保護言論自由，與《美國憲法第四修正案》中的禁止無理搜查和扣押條文。[2]

2015年10月，美國馬里蘭聯邦地區法院駁回了原告的請求。[8]4個月後，維基媒體基金會上訴至美國聯邦第四巡迴上訴法院。[9]二審認為初審判決基本合適，不過原告維基媒體基金會的主張「可行」，准許發還下級法院重審[10]，同時撤銷其他原告方的訴訟。[9]結果下級法院裁定基金會沒有繼續索賠的資格，後續上訴也被第四巡迴上訴法院駁回。[11]

背景

上游收集（英語：Upstream collection）監聽計畫最早由前國安局職員愛德華·斯諾登於2013年5月揭發[12]。在本案之前，美國公民自由聯盟便已經代理過國際特赦組織美國分會控告克拉珀案（英語：Clapper v. Amnesty International USA），結果因證據不足而敗訴。而在斯諾登洩露的國安局文件中，有一份介紹敏感分隔資訊（英語：Sensitive compartmented information）的簡報，裡面特別將維基百科列為HTTP監視的目標，維基媒體基金會因而以此指控國安局侵犯用戶憲法第一和第四修正案權利[13]。

自克拉珀案以來，美國政府確認了國安局進行上游蒐集的關鍵事實，特別是對沒有嫌疑的人進行蒐集[14]。美國公民自由聯盟律師帕特里克·圖米（Patrick Toomey）指出，此案對於原告而言特別重要，因為原告每年進行數以千億計的國際通訊（英語：International communication）[14][15]。

司法進程

2015年8月6日，案件原告美國國安局及美國司法部提出撤訴動議，理由是原告方沒有合理證據證明受到上游搜集損害，缺乏起訴理據。對此，電子前哨基金會代表圖書館員及書店店主發出法庭之友[16]。雙方於2015年9月25日的聽證會上進行辯論[17]。

2015年10月23日，馬里蘭州地方法院基於當事人資格（英語：Standing (law)）駁回訴訟，地區法官T. S. 埃利斯三世（英語：T. S. Ellis III）裁定原告沒有合理證據證明受到上游搜集，並援引了2013年克萊普案的判決[18][19]。維基媒體基金會表示會提出上訴，因為指控其來有自，上游監視無疑捕獲了到用戶社群及基金會本身的通訊內容[20]。電子前哨基金會認為案件牽涉的監控計劃是秘密行動，以缺乏當事人資格的理由撤訴不合理，敦促聯邦法庭解決上游監控帶來的嚴重憲法問題[21]。2016年2月17日，原告方向美國第四巡迴上訴法院上訴[22]。

2017年5月23日，第四巡迴上訴法院正式撤銷下級法庭的裁決[23][24]，指基金會對國安局違反第四修正案的指控合理，「當事人資格足以證明裁決文面違憲（英語：facial challenge）」，認為國安局搜集隱私數據所造成的潛在傷害難以預測[9][23]。因此，上訴法院將案件發還馬里蘭州地方法院，要求繼續審理[10]。相反，法庭支持埃利斯撤銷其他原告方的訴訟，認為他們沒有足夠證明業務受到上游監控範疇影響[9][23]。

2019年12月16日，地區法院裁定基金會沒有繼續索賠的資格。2020年2月14日，基金會向第四巡迴上訴法院提出上訴[25]。案件於2021年3月舉行聽證[26]，同年9月再次被駁回[11]。
