愛爾蘭憲法第三十六條修正案（2018年第二十九條法案）是愛爾蘭憲法的一項修正案，允許愛爾蘭議會立法允許墮胎，廢除第八修正案（即1983年憲法修正案（英語：Eighth Amendment of the Constitution of Ireland））。根據第八修正案，胎兒有生命權，除非懷孕威脅孕婦的生命，否則墮胎是違法的。2018年的修正案將取代1983年增加並於1992年修訂的憲法第40.3.3條。

該草案於2018年3月9日由少數派聯合政府提交給愛爾蘭議會，並於2018年3月27日通過兩院審核。2018年5月25日進行公民投票，決定該否修正憲法。[1]66.4％的選民贊成刪除憲法禁止墮胎的修正案。

背景

英國《1861年侵害人身罪法令（英語：Offences Against the Person Act 1861）》將「非法流產」定為犯罪行為，1922年愛爾蘭獨立後仍然生效。1983年憲法第八修正案宣佈「胎兒的生命權……與母親的生命權相等」，這次修正案是保守派組織「生命權修憲運動」為了阻止1861年的禁令可能被自由派議員或活動家削弱而推動的。[2]1992年的「X案」（檢察總長訴X案（英語：Attorney General v. X））裁定，在懷孕威脅婦女生命的情況下，包括自殺風險，可允許墮胎。在歐洲人權法院案件和2012年薩維塔·哈拉帕那瓦之死的推動下，出台了《2013年孕期生命保護法令》。[3]2013年的法令廢除了1861年的法令，並將「破壞未出生的人類生命」定為犯罪。在2014-2016年的三年中，根據2013年法案共進行了77次合法墮胎。[4]自1967年英國《墮胎法》允許愛爾蘭婦女前往英國進行合法墮胎以來，愛爾蘭的非法手術墮胎幾乎無法統計。在X案之後於1992年通過的憲法第十三和第十四條修正案保證了有關國外墮胎的信息和出國旅行的墮胎權。英國墮胎診所接待的愛爾蘭女性人數在2001年達到6,673人，2016年達到3,265人。[5]下降的部分原因是由於網上藥店非法提供墮胎藥。[6]

在愛爾蘭因受到天主教教義的影響，大部分需要墮胎的情況，包括胎兒畸形或因姦成孕之類，都不會批准墮胎，只有當孕婦生命受到威脅的時候，才可以做手術放棄懷孕。導致當地有數以千計的女性會到外國又或者上網買藥來墮胎。

修正案內容

The State acknowledges the right to life of the unborn and, with due regard to the equal right to life of the mother, guarantees in its laws to respect, and, as far as practicable, by its laws to defend and vindicate that right.

國家承認胎兒的生命權，並在適當考慮到母親的平等生命權利的情況下，保證其法律尊重並儘可能依照其法律捍衛和維護該權利。

This subsection shall not limit freedom to travel between the State and another state.

本款不限制國家與另一國之間的旅行自由。

This subsection shall not limit freedom to obtain or make available, in the State, subject to such conditions as may be laid down by law, information relating to services lawfully available in another state.

投票於2018年5月25日愛爾蘭時間07:00（UTC+1）開始，22:00結束。計票從5月26日的09:00開始。所有經過選民登記的愛爾蘭公民均有資格投票。年度登記選民共有3,229,672人（截至2018年2月15日），並在截至2018年5月8日截止日期前增補了118,389名選民[11][12][13]延遲註冊數量異常多。[14]《愛爾蘭時報》進行的一次出口調查預測贊成修正案的有68％[15]，而由愛爾蘭廣播電視進行的一項調查預測結果為69.4％[16]。投票後的第二天，「拯救第八修正案」運動正式承認失敗。[17]
