《2019年欧洲联盟（脱离）法令》（英语：European Union (Withdrawal) Act 2019，俗称“顾利氏法令”），是英国国会一条法令，旨在延长《里斯本条约》第50条（英语：United Kingdom invocation of Article 50 of the Treaty on European Union）所定义的英国脱欧谈判期。法案在2019年4月3日由工党议员顾绮慧和保守党议员奥利弗·莱特温爵士提交下议院，当日国会议程罕有地由议员而非英国政府掌控。无论是在下议院还是上议院，英国政府都一直表明反对此法案[1]。

法令在2020年1月23日被《2020年欧洲联盟（脱离协议）法令（英语：European Union (Withdrawal Agreement) Act 2020）》废除[2]。

内容

法令架构如下：

  • 弁言
  • 第1条“有关延长第50条的职责”：规定政府要容许国会辩论要求首相寻求延长根据《欧洲联盟条约》第50(3)条所订的英国脱离欧洲联盟协议条款谈判期的动议，动议必须在2019年4月8日或9日获通过并获御准。若获通过则首相有法律义务履行法令并寻求延长谈判期至由国会选定的日期，惟延期仍需获欧盟同意。
  • 第2条“确保国内立法配合延长第50条的程序”：详列修订英国法律以反映新的“离开日”（即脱离欧盟当日）的程序
  • 第3条“释义、生效、范围及简称”

立法历程

下院首读二读

2019年4月2日，下议院通过翌日暂停实施会议常规，议员事务可比政府事务获优先处理。4月3日，工党议员顾绮慧和保守党议员奥利弗·莱特温爵士呈交《欧洲联盟（脱离）（第5号）法令草案》，并动议下议院在一日内完成二读、委员会和三读程序。有关动议以一票之差获通过[3][4]。

当脱欧事务大臣史提芬·巴克莱表明政府的反对立场后，法案以5票之差获二读[5][6]。

上院首读二读

4月4日，影子上议院副议长根特舒镇的夏德雅女男爵（英语：Dianne Hayter）在上议院提交本法案。为压缩审议程序至一日，希特又作出两项动议[18]：

  • 免除会议常规第46条（单日不得处理某法案的两个阶段），容许《欧洲联盟（脱离）（第5号）法令草案》得以在今日处理所有程序
  • 免除会议常规第39条（各类事项程序），容许在完成经济事务委员会霍司富男爵的动议后，审议《欧洲联盟（脱离）（第5号）法令草案》。

保守党对此感到不满，并在政府支持下开始拉布，阻止法案获得上议院的同意。六名保守党上议员提出修订希特的动议，议会因而需要辩论和表决[19][20]。但最终希特动议仍然获得同意，而法案同日首读和开始二读[21]。但由于二读辩论在晚上7点休会前仍未开始，因此法案未能在一日内走完上议院所有程序，要待下周一继续[22]。

上院三读

委员会阶段完成后即进入报告阶段，没有实质内容[31]。再之后进入三读程序，并在无反对下获得通过，法案随即送返下议院[32][33]。

下议院同日审议上议院通过的五项修正案，其中第1至4号修正案在无表决下通过，而第2、3和5号修正案和祈伟霖爵士提出的第(a)号修正案则须进行表决程序。

后续

2019年4月9日，首相根据本法令第1条，动议延长脱欧谈判至同年6月30日，并在同日获大比数通过[41]。
